HomeMy WebLinkAbout1474 ~v 490510 ii f E A S E M E N T IT IS HEREBY AGREED THAT TARPON BAY VILLAS a Florida partnership and TARPON BAY VILLAS HOMEOWNERS ASSOCIATION, INC., a 4 Florida non-profit corporation, hereinafter called Grantor, for the 'sum of one dollar ($1.00) and other good valuable consideration paid by ANDREW~A. HENRY and ALBERTA D. HENRY, their heirs and assigns, hereinafter called Grantees, does grant, sell, and convey unto Grantees an easement and right-of-way upon and across the following described property of the Grantor: All of the Common areas of TARPON BAY VILLAS as set forth in the Plat thereof recorded in the Official Records of St. Lucie County, in Plat Book 20, Page 15, and more particularly described as all those portions shown on the above described plat of TARPON BAY VILLAS which are not separately identified as a numbered unit or lot. The right-of-way easement rights, and privileges herein granted.. shall be used only for the purpose of providing pedestrian ingress and egress for private passenger and recreational vehicles, ~ said right-of-way shall be invalid as to any other type of vehicles. The easement rights and privileges herein granted shall terminate and cease to exist at such time as the property running from ~ the Westerly boundary of TARPON BAY VILLAS to the shore of Bitching Cove, (containing approximately 2.5 acres) shall cease to be used for a single-family residence.
