ORDER COMPELLING DISCOVERY
This cause came on to be heard the 23rd day of June, 1980
upon the motion of GREENBRIER PLAZA, INC. for an order compelling
discovery against MLP CONSTRUCTION, INC._, the plaintiff. Upon due
notice of hearing and the parties being represented by counsel,
counsel for the plaintiff acknowledged that he had no defense to
the motion and that already a reasonable time had elapsed for such
discovery, and that the items sought to be discovered had previously
been agreed upon by the plaintiff and his counsel at a deposition
taken of Michael L. Perkins, President of :~II..P CONSTRUCTION, INC. ~
on April 18, 1980, it is thereupon,

ORDERED AND ADJUDGED, as follows:

That the Plaintiff, MLP CONSTRUCTION, INC, comply in full
with the following within 10 days from date hereof and deliver same to
~ Spencer B. Gilbert, attorney for defendant and counterclaimant
GREENBRIER PLAZA, INC,:

.1. On page 21 of the deposition of April
you and Mr. Perkins agreed that you would give
me, under oath a document with the itemization
called for giving a breakdown on the amount that
comprises the $79,312.00 which MLP Construction,
~ Inc. claims.is unpaid. This was to be sworn to
~ before a notary public.
a "2. On page 22 of the aforesaid deposition, it was
again agreed upon that the $79,312.00-claimed as
j unpaid under the lien, be itemized in sufficient detail
so that the Defendant, Greenbrier Plaza; Inc., would '
know exactly who is owed, when the debt was incurred,
for what and exactly how much.
