That Order correctly states this Court's feelings with regard to the applicable law based on the speci- - fic facts that were before this Court. In that Order of April 23, 1980 the Court-gave the parties ninety (90) days from that date in which to amend their complaints to allege additional jurisdictional facts should they care to do so. The Court specifically notes that on May 29, 1980 the deposi- tion of Charles Redfern, the Vice-President of sales and marketing of the Defendant, PLASTIC INDUSTRIES, INC. was taken. The Court notes that the Plaintiffs have filed a Fifth Amended Complaint alleging additional jurisdictional facts based on the deposition of Mr. Redfern. These in- clude Paragraph 14 and 15 of the Fifth Amended Complaint which state: "14. The Defendant, PLASTIC INDUSTRIES, INC., has had and continues to have a representative in the State of Florida who is authorized to display and sell products manufactured by the Defendant, PLASTIC I~iDUSTRIES,-INC., to Florida furniture manufactuerers. Said representa- tive has displayed the Defendant's products to Florida furniture manufacturers through catalogs and other means ' supplied by the Defendant, PLASTIC INDUSTRIES; INC., and has accepted orders for the Defendant from Florida furni- ture manufacturers. Said representative is paid a 5$ commission by the Defendant for any product he sells in the State of Florida. Attached is a list of the Defendant's PLASTIC INDUSTRIES, INC., customers in the State of Florida. 15. The Defendant, PLASTIC INDUSTRIES, INC., advertises it products in the State of Florida through ads which are placed in furniture trade magazines, such as "Furniture South," "Furniture Products," and "Furniture Methods and. Materials," wbich the Defendant, PLASTIC INDUSTRIES, INC., knew or should have known, have subscribers in the State of Florida, and the Defendant has benefited by the sale of its products from said advertising in the State of Florida." t2) ratc~ 6C0~ JJ~ PJ~GE 1 - - - -
