HomeMy WebLinkAbout0066 This Court has reviewed the deposition of Charles Redfern,
and specifically makes the following findings of fact:
' 1. The Defendant, PLASTIC INDUSTRIES, INC., presently has
and has had, for at least four years, and possibly as early as 1965,
the exact period of time undetermined, a commissioned representative
who sells the Defendant's, PLASTIC INDUSTRIES, INC., products to Flor-
ida furniture manufacturers, and is paid a commission for the sale of
these products by this same Defendant. (See deposition of Redfern pg.24-25)
2. The commission representative of the Defendant, PLASTIC
INDUSTRIES, INC., has several different lines of the Defendant,
PLASTIC INDUSTRIES, INC., and carries different products. (See deposi-
tion of Redfern pg. 25) -
3. The present commission representative, who is identified
as Frank Hughes, works in .the State of Florida, and resides in the State
of Florida. (See deposition of Redfern pg. 25-27)
4. 'The commission representative uses catalogs supplied to
the commission representative in the State of Florida, by the Defendant;
PLASTIC INDUSTRIES, INC. These catalogs are used by the commission
representative to sell the products of PLASTIC INDUSTRIES, INC. to
Florida furniture manufacturers. The Florida furniture manufacturers
would purchase products from the Defendant, PLASTIC INDUSTRIES, INC.,
through the Defendant's commission representative in the State of
Florida. (See deposition of Redfern pg. 48-50)
5. The Defendant, PLASTIC INDUSTRIES, INC., has been ad-
vertising cff and on for the last twenty years in national furniture
manufacturer trade magazines, which include "Furniture South", "Furni-
ture Production", and "Furniture Methods and Materials". These maga-
zines were known or should have been known to the Defendant, to have
subscribers in the State of Florida, and to be used by Florida furniture
manufacturers in their ordinary course of business. (Plaintiffs' filed
Affidavits from the President of Halsey and Griffith, and others indica-
ting that these magazines do indeed have subscribers in the State of
Florida, including one of the Co-Defendants, HALSEY AND GRIFFITH, INC.)
