THIS CAUSE came on to be heard on the 4th day of December,
A.D. 1979, upon the Defendant's Motion To Dismiss For More Definite
Statement and Plaintiff's Motion For Physical Examination, and the
attorney for the Defendant having announced to the Court that she
believed the Plaintiff's Complaint did state a cause of action and
that the Defendant was withdrawing the Motion For More Definite
Statement, and the Court having examined the Plaintiff's Motion For

.Physical Examination, and being otherwise fully advised in the pre-

mises, it is thereupon

ORDERED AND ADJUDGED, as follows:

1. That the Defendant's Motion To Dismiss, be, and is ~
hereby ordered denied.
2. That the Plaintiff's Motion For Physical Examination.,
be, and is hereby ordered granted and each of the parties hereto,
DEBORAH ANN BYERLY and STEVEN ROGERS, be, and are hereby ordered to
submit to such physical examinations as this Court shall require in
a subsequent order, and it, be, and is hereby further ordered that
` the Plaintiff shall bear costs of the tests ordered by this Court to ~
be made and done and submitted to by both of the parties.
3. That this Court expressly reserves jurisdiction over
