THIS CAUSE came on for final hearing upon the former
i
husbands', RICHARD P. BERISH'S, Petition for Modification. The j
former husband was represented by Jay R. Jacknin, and the former
wife was represented by W. Thomas Wackeen. Upon the evidence
presented and the Court being advised in the premises, it is -
ORDERED AND ADJUDGED as follows:
1. The Court finds that there has not been a substan- ~
t
tial change in circumstances in regard to the alimony provision
of the Final Judgment and grants the Motion for directed verdict '
by the former wife.
2. The Court finds that there has been a substantial
change in circumstances with regard to the marital dwelling located
at 7505 S. Indian River Drive, Fort Pierce, Florida in that for the
k past eighteen months the marital dwelling has been abandoned. The
court orders an appraisal to be made within thirty (30) days and the
house is to be partitioned and sold with the proceeds divided as
set forth in the Final Judgment. All expenses including the appraisal
shall be deducted from the closing proceeds. The legal description of
the marital residence is mere specificall}~ described as follows: _
Begin at the Northwest corner of Section 18,
F Township 36 South, Range 41 East, run East along
the North line of said Section•18, 213.39 feet to
the point of intersection of the said Section line .
~ with the East right of way line of the Florida East
Coast Railway; thence run Southeasterly along said
East right of way line, 202.30 feet to the point of
~ beginning of the tract hereinafter described; thence
continue along said East right of way line, 202.30
~ - feet to a point; thence run East parallel to said
Section line, 1032.5 feet to the West bank of the
