MORTGAGE MODIFICATION AGREEMENT
i
THIS AGREEMENT, made this ~ day of June, 1980, by and
between C. A. VAN DER LUGT and JUDITH B. VAN DER LUGT, his wife,
hereinafter referred to as "Mortgagors", and SUN BANK OF ST.
LUCIE COUNTY, FLORIDA, a Florida banking association, with its
principal place of business at 111 Orange Avenue,. Fort Pierce,
Florida, hereinafter referred to as "Mortgagee"; _
W I T N E S S E T H E
WHEREAS, on the 8th day of December, 1977 Mortgagors borrowed
from Mortgagee the sum of Fifty-Five Thousand ($55,000.00) Dollars
and executed and delivered to.Mortgagee their promissory note
for said amount payable on or before June 8, 1979, bearing interest
at the rate of Ten (10$) Percent per annum; and
WHEREAS, the indebtedness evidenced by the aforementioned
Fifty-Five Thousand ($55,000.00) Dollar promissory note is secured
by a first mortgage given by Mortgagors. to Mortgagee on the following '
described lands in St. Lucie County, Florida:
Beginning at a point marking the intersection of the
west line of the NE 1/4 of Section 5, Township 35
South, Range 39 East with the South line of Angle
Road West right of way; thence run South 89°25'25"
East along said right of way line 899 feet; thence
leaving said right of way line run South 0°40'20"
West 1690 feet to a point, thence run North 89°25'25"
West 862 feet to a point on the east right of way of
canal No. 53 of the North St. Lucie River Water ~
Management District; thence run North 0°40'20" East ~
along said right of way line 328.30 feet to end of
canal, thence run west 37 feet to point on the
west line of the said NE 1/4 of Section 5; thence
run North 0°40'20"-East along said west line of NE
1/4 a distance of 1361.70 feet more or less to the
point of beginning;
and
WHEREAS, said first mortgage dated December 8, 1977 was
recorded on December 8, 1977 in Official Record Book 278 at
page 1266 of the Public Records of St. Lucie County, Florida;
and
