HomeMy WebLinkAbout0690 WHEREAS, the maturity date of the above described mortgage and the promissory note secured thereby was extended to June 8, 1980 and the interest rate was increased to eleven and three- quarters (11-3/4$) percent from June 8, 1979 by virtue of that certain Modification Agreement between Mortgagors and Mortgagee dated June 11, 1979 and recorded on June 12, 1979 in~Official Record Book 310 at page 1322 of the Public Records of St. Lucie County, Florida; and WHEREAS, the above described land has been subdivided into a residential subdivision known as Country Living Estates Sub- division as per plat thereof recorded in Plat Book 18 at page 13 of the Public Records of St. Lucie County, Florida, the dedication of which plat was joined in by Mortgagee; and WHEREAS, Mortgagors are the present owners of all of the lots in Country Living Estates Subdivision except for Lots 1, 7 and 10, Block A,and Lots 1, S, 6, 7, 8 and 11, Block B which have been conveyed to third parties and which have been released from the Lien and operation of the aforementioned mortgage; and WHEREAS, the parties hereto desire to modify the terms of payment of the indebtedness evidenced by the aforementioned promissory note of Mortgagors; NOW, THEREFORE, in consideration of the premises and mutual covenants hereinafter set forth, the parties hereto agree as follows: 1. Mortgagors represent and warrant that they are the owners of all of the lots in Country Living Estates Subdivision, except for Lots 1, 7 and 10, Block A, and Lots~l, 5, 6, 7, 8 and 11, Block B which have previously been conveyed to third parties, and that there are no liens or encumbrances against said lots owned by Mortgagors other than the aforementioned mortgage and real-estate taxes accruing subsequent to December 31, 1979.
