by the aforementioned promissory note is in the amount of Twenty-
Six Thousand Six Hundred Ninety-Five ($26,695.30) Dollars and
30/100 and accrued interest on said indebtedness has been paid
through June 8, 1980.
3. Interest on the unpaid principal balance on the above
described promissory note shall be payable in consecutive quarterly
installments, the first such installment to be due on September 8,
1980. Interest shall accrue at a rate equal to the prime rate
charged by the Sun First National Bank of Orlando at the beginning
of each quarterly interest payment period; provided, however, that
in no event shall interest exceed the maximum rate allowed by the
laws of the State of Florida.
4. The entire outstanding principal balance of the above
described promissory note and all accrued interest shall be due
and payable on June 8, 1981.
5. This Mortgage Modification Agreement supersedes all
previous Mortgage Modification Agreements between the parties.
6. Except as hereby modified, all other terms and conditions
of the aforementioned promissory note and mortgage are hereby
ratified, confirmed and approved.
7. Nothing contained herein shall be construed to impair
the security of Mortgagee under the aforementioned mortgage.
8. This Agreement shall be binding upon the parties hereto
and their personal representatives, heirs, beneficiaries, successors
and assigns.
IN WITNESS WHEREOF, the parties have hereunto executed this
Agreement the day and year first above written.
