- THIS CAUSE having come on before the Court upon
its own Motion, the Court having been advised by counsel
for the Plaintiff, FLORIDA BANR AT FORT PIERCE, that the
Defendant, EUGENE J. HORN, did post a cash bond of $200.00
securing his appearance before this Court on June 18, 1980
at 8:45~a.m., and did further subject himself to the depo-
sition requested by the Plaintiff, before said date and
~ time, and thereafter, by consent of Plaintiff's counsel,

~ did not appear before this Court, it is hereby i
- ORDERED AND DECREED as follows:
' 1. The Defendant is hereby. purged on any contempt
- of this Court as a result of his refusal to previously appear
at scheduled depositions;

2. The cash bond posted by a third party for
the Defendant, EUGENE J. HORN, shall be forthwith remitted
and returned by the Sheriff of Saint Lucie County to the
individual posting the same.
