The Petitioner, Eugene Kane, alleges: ~

1. Petitioner has an interest in the above estate as
being the nephew-in-law of said decedent, having been the guardian
of the person and property of.said decedent, and there being no
known kin of said decedent. Petitioner's name and address are
Eugene Kane, Meads Lane, Stormville, New York 12582, and the name ~
and address of petitioner's attorney are as set forth at the end
of this petition.
2. Decedent, Daisy Solomon, whose last known address was
i 404 North 28th Street, Ft. Pierce, Florida, died on May 20, 1980,
at home, and at the time of death decedent was domiciled in St. Lucie
County, Florida.
3. So far as is known, the names of the beneficiaries of
this estate, their addresses and relationships to decedent,, and the
ages of any who are minors, are:

- 5. Eugene A. Kane, whose address is Meads Lane, Stormville,
~ New York 12.582, is entitled to preference in appointment as Personal
~ Representative because he was the only relative of Herman Solomon, the
decedent's late spouse (Estate is in probate in the St. Lucie County
Court, #80-49-CP) and he was the a ointed
pp guardian of the person and
property of Daisy Guardian (St. Lucie County Court X80-92).
6. The nature and approximate value of the assets in this
estate are: Real and personal property in the approximate value of •
$48,000.00.

7. After the exercise of reasonable diligence, petitioner
is unaware of any unrevoked wills or codicils of decedent.
