This cause coming on to be heard for trial on the. Wife's
Petition For Modification and the Court having heard testimony -
of the parties and witnesses and argument of Counsel, and the
Court finding that under the terms of the Agreement that it is
i necessary .that the Court interpret the .Agreement as entered
into by the parties, and the Court finding that it was the ;
I
. intent of the parties in August of 1977 that each party would
have aone-half equity in Parcels One aid Two described in -
the Petition filed herein and that Parcel I in August of 1977
had an equity of $5,000.00 for each party and that Parcel II
had an equity of $30,000.00 for each party, and the Court find-
ing that the Wife has remarried and that the Wife's rights of

~ exclusive possession of Parcel I is terminated and that Parcel
~ I and Parcel II shall now be divided by agreement or sold and

the Husband has an equity of $5,000.00 or one-half of the sales
price, whichever is greater, as to Parcel I, and that the Wife
has an equitable interest of a minimum of $30,000.00 or one-half
- of the sales price, whichever is greater, in Parcel II, and that '
such equity lien is superior to any encumbrance on the property
subsequent to August of 1977, and the Court finding that the
Wife's attorney has provided valuable service on her behalf and
that the Husband shall pay the costs of this proceeding and con- `
I tribute $750.00 towards the Wife's attorney's fees, it is
