ORDER
THIS CAUSE coming on to be heard upon Lucieland Corpora-
tion's Motion for-Payment of Real Estate Broker's Commission and
upon Petition for Payment of Attorney's Fees and Court costs,
and the Defendant Betty E. Daigle, having withdrawn her Answer
• to the Petition, it is, therefore, ORDERED AND ADJUDGED that at
the time of closing on the subject property, the said Betty E.
Daigle shall pay from the closing proceeds and escrowed funds a
real. estate broker's commission consistent with the terms of the
sales contract. On said date, Guy R. Bruni, Esquire, counsel for
Lucieland Corporation, shall cause to be delivered to the place of
closing the deposit monies held in his trust account pursuant to
this Court's Order of May 19, 1980 for disbursement as per the -
sales contract. -
It is further ORDERED AND ADJUDGED that Lucieland Corpora-
tion is awarded the sum of $500.00 as attorney's fees for its,
attorney, Guy R. Bruni, Esquire, for representation of Lucieland ~
Corporation in the dispdte pertaining to the issue of whether or
not a real estate broker's commission was owing, said amount to
be distributed from closing proceeds due Betty E. Daigle on the
date set for closing in accordance with the terms of the sales
contract between Betty E. Daigle and Robert F. McRoberts, Jr.
This Order supersedes the Order of Court previously
entered on this matter on the 30th day of June,-1980.
