hereby stipulate and agree as follows:
1. The Defendant's Motion to Dismiss previously filed
herein shall be considered granted to the extent that Paragraph 5 i
of the Plaintiff's Complaint shall be by this reference deleted
from said Complaint, otherwise, the Defendant's Motion to Dismiss
shall be denied and the Defendant shall have ten (10) days from
the date of the signing of the Order approving this stipulation
within which to file an Answer herein..
