INC., a Florida corporation, hereinafter referred to as "Declarant". WHEREAS, the Declarant is the owner of certain property located in Fort Pierce, County-of St. Lucie, State of Florida, and has recorded a plat of such property in Plat-Book Z1 , Page ~ , of the Public Records of St. Lucie County, Florida= and WHERBAS, it is the intent of the Declarant that the restrictions, covenants and conditions hereinafter set forth be imposed upon the lands of said platted subdivision for the benefit and as a burden upon such lands. - NOW THERBFORE, Declarant hereby declares that all of the properties depicted in the above-described plat shall be held, sold and conveyed- subject to the following easements,~restrictions, covenants and conditions, which are for the purpose of protecting the value and desirability of and which.-shall run with, the- real- property and be binding on all parties having any right, title or interest in the properties or any part thereof, their heirs, successors and assigns and shall inure to the benefit of each owner thereof.. f ARTICLE I - - DEFINITIONS AND GENERAL PROVISIONS f 1. "Association" shall mean and refer to •the FRENCH CREEK PROPERTY OWNERS ASSOCIATION, (a non-profit corporation), its successors and assigns. 2. "Declarant" shall mean and refer to PERGUS DEVELOPMENT, ING., its successors and assigns. - 3. "Owner" shall mean and refer to the record owner, whether one or more persons or entities, of a fee simple title to any Lot which is a part of .the Properties, idcludfng contract sellers, but excluding those ' having such interest merely as security for the performance of an obligation. - 4.
