ARTICLE III MBMBERSHIP AND VOTING RIGHT8 1. ~ Membership. Bvery owner of a Lot shall be a member of the Association. Membership shall be appurtenant to and may not be separated from ownership of any Lot. 2. Voting Rights.. The Association shall have two classes of voting ~aembership with ,those classes being labeled "Class A" and "Class B". . a. Class A. Class A members shall be all Owners, with the exception of the Declarant, its successors and assigns and shall be entitled to one (1) vote for each Lot owned. When afire than one person or entity holds an interest in any_Lot, all such persons or entities shall be members with the vote for~such Lot being exer- cised as they determine, however, in no event shall more than one vote be cast with respect to any Lot. b. Class B. The Class B member(s) shall be the Declarant, its . ~ successors and assigns and shall be entitled to three (3) votes for each Lot owned. The Class B membership shall cease and become converted to Class A membership when the total votes oustanding~in the Class A membership equals or exceeds the total votes out- standing in the Class B membership. ARTICLE IV MAINTENANCE ASSESSMENTS 1. Lien and Personal Obligation for Assessments. The Declarant : - _ for each Lot owned within the Properties, hereby covenants, and each Owner of any Lot by acceptance of a deed therefor, whether or not it shall~be so expressed in such deed, is deemed to covenant and agree to pay to the Association: (1) annual assessments or charges for common area utility service, maintenance and capital improvements as set forth in paragraph 4 of Article IV='(2) special assessments for lot 3 p~ BQ01(~5 PAGE', e~ s- ~
