The Association or any Owner shall have the right to enforce by any proceedings at law or in equity, all restrictions, conditions, covenants, reservations, liens and charges now or hereafter - i~apoaed pursuant to the provisions of this Declaration. Failure by the Association or by any Owner to enforce any restriction, condition, . covenant, reservation, lien or charge herein contained shall in no event be deemed a waiver of the right to do so thereafter. 2. Severability. Invalidation of any of these covenants or restrictions by judgment or Court order shall in no way affect any other provisions and they sfiall remain in full force and effect. 3. Modification. ,The Declarant hereby expressly reserves the right in its sole discretion to, at any time, annul, waive, change or modify any of the restrictions, conditions, covenants, agreements and provisions contained in this Declaration as to any Lot or part of the Properties then owned by the Declarant, so long as the Declarant shall have obtained the consent of the majority of the Owners of all other Lots in the subdivision. 4. Amendment. This Declaration may be amended at any time and ~ from time to time upon the execution and recordation in the public ~ records of St. Lucie County, Florida, of an instrument executed by owners holding not less than two-thirds (2/3) of the voting interests of ~ the Association's membership.
