The Court further finds, adjudges and decrees that•the deceased did not have said Fivs Thousand Dollars (=5000.00) Oklahoma Gas and Electric Company Band at the time of~his death; therefore, as provided in said Mill, the sua of Five Thousand Dollars (65000.00) shall be provided from the residue of said estate 3n place of said Bond for the pwc~wses of taking care E of the graves in said cemetery lot of the deceased in Suamit View Cemetery of Guthrie,•Oklalroma. That said sum shall be used and irnested.in the } same maamer as if said Bond were in existence at the time of decedents' death and any surplus paid to the Oklahoma Newpaper.Fotmdation the same as the surplus from the Bond would have been. The Court further finds that the Executor has filed a Motion in this proceeding requesting that the said . ~ ;5000.00 for the care of~said cemetery lot be paid to the Oklahoma Newspaper , Frnmdation as Trustee rather than the First National Bank of t~thrie of ! k • Guthrie, Oklahoma. The Court further finds-that there is also pending a E Motion to set the aaaunt of attorney fee?for the Executor's attorney. It ` is therefore ordered that both the said Motions are set for hearing on the i 10th day of September, 1979 at 1x00 P.M. and that the Executor is hereby ~ i ordered not to distrubute arty funds of said estate until the Coat rules f on said Motions. - The Court further finds, adjudges and decrees that under and by virtue of the Last Mill_and Testament of said deceased that the said deceased created a T4~ust labown as "The Raynand~H. and Mildred F. Fields Memorial TYust~'•with the Oklahoma Newspaper Foundation T~CUStees, as TYvstees of this trust. That the said trust consists of the rest residue and remainder of the estate of the decedent as hereinabon?e stated. That such T~cvstee shall have s the-powers and duties as provided under the tenors and provisions of the Oklahoma Trust Act oz` as such Trust Act may be from time to time amended, and if such TYust Act be repealed then as .such Trust Act exists at the time of such repeal.
