BEFORE ME, the undersigned authority, personally appeared
~ WALTER S. FALK, well known to me, who first being duly sworn and
cautioned, did depose and say:
1. Your Affiant is the President of METROPOLITAN MORTGAGE
COMPANY, a Florida corporation, which is and at all material times
has been a licensed mortgage broker under Chapter 494, Florida
Statutes.
4. 2. On August 22, 1974, a certain PAUL LOBL executed and
~ delivered an instrument entitled "Declaration of Trust" an original
~ of which is attached hereto as an exhibit.
3. Said PAUL LOBL died on the 15 day of December '
1978 and attached hereto is an original death certificate.

4. Your Affiant knows of his own knowledge that said o
Declaration of Trust was in full force and effect and unamended at c_ _
all times from and including August 22, 1974 until the date of his
death.
5. Your Affiant knows of his own personal knowledge that {
from August 22, 1974 until the date of his death, certain mortgages 1..=
originated by METROPOLITAN MORTGAGE COMPANY as a/mortgage broker,
were"acquired by PAUL LOBL, as Trustee and that such mortgages were
subject to said Declaration of Trust. The mortgages still in
existence at the time of the death of PAUL LOBL are set forth in :r
the schedule attached hereto. Pursuant to said Declaration of
Trust and the laws of the State of Florida, RENA LOBL is the owner
of the legal and equitable title thereto.
