No carports will be permitted. All out buildings and utility buildings shall be constructed of new material and shah remain consistent with the exterior color of the residence. 12. Garbage cans, garbage containers and trash bags shall not be visible except twelve (12) hours prior to, and twelve (12) hours after scheduled pickup. 13, Each home shall have a front elevation consist- ing of at least 35 percent of wood, stone or brick. All remaining exterior walls shall be stucco with the use of earth tone colors. 14. Each lot shall, at the time of issuance of a Certificate of Occupancy by the Building Department of St. Lucie County, have a minimum of X500,00 worth of plants and 7,500 square feet of sod, which sod shall extend to the pavement. Within 30 days of occupancy of the house, all windows shall have drapes. ' 15. Individual wells may not be used for domestic _ water service. Lot owners may have individual wells for watering yards and gardens only. 16. Holiday Pines, A Florida General Partnership for themselves and for their successors or transferees, reserve the right to make reasonable modifications and/or amendments to any or all of the foregoing protective covenants and restric- tions, so long as they shall own any part .of said lands. When Holiday Pines shall have sold all of the aforesaid lands, said right of modification shall vest in the owners of the lands. At such time, any modifications or amendments must be approved by two-thirds or more of the lot owners. 17. Violation of any of these Covenants~by judgement of court order shall in no wise affect any of the other provisions, ~ which shall remain in full force and effect. These Protective Covenants and Restrictions shall be interpreted in accordance with the laws of the State of Florida. Should judicial en- forcement or interpretation of these Protective Covenants and Restrictions be required, it is agreed that the Circuit Court of St. Lucie County, Florida shall have jurisdiction thereof. These Protective Covenants and Restrictions are p to run with the land and shall be binding on all parties and all persons claiming under them for a period of 20 years, commenc- ~ ing from the date of this Declaration, at which time said Protective Covenants and Restrictions shall be automatically ~ extended for successive periods of ten years unless, by a vote of two-thirds of the then lot owners covered by these Protective Covenants and Restrictions, it is agreed to change said Covenants. in whole or in part.
