ORDER
This cause having come on for final hearing before this court on
the 31st day of July, 1980 and the court having heard the testimony of
the parties and the witnesses and the arguments of counsel and'the court
being otherwise fully advised in the premises this court finds from the 3
evidence that the Defendants/Counter Claimant did not give proper legal
notice of the defects alleged in the Counter Claim filed herein and it ~
is hereupon
ORDERED AND ADJUDGED that the Counter Claim filed herein be in the

same is hereby denied.
This court further finds from the evidence that the tender of payment

at the Sun Bank of St. Lucie County, Florida, March 6, 1980 was made to

j the last known authorized agent of the plaintiffs/Counter Defendants was
therefore, properly made and it is hereupon ~
~ ORDERED AND ADJUDGED that the Complaint for Foreclosure be in the

~ same is hereby dismissed. It is further

ORDERED AND ADJUDGED that the Defendants/Counter Claimants shall ~
bring current all payments, interest and late charges due under that
certain promissory note and mortgage securing payment thereof which was .
i
the subject of the foreclosure complaint filed herein and that said payment
shall be brought up to date by September 1, 1980. It is further
ORDERED AND ADJUDGED that this court shall retain jurisdiction of
this cause and the parties hereto in order to enforce provisions of this
order; that the original documents entered into evidence at the hearing
