- WHEREAS, a portion of the land encumbered by the Mortgage
has previously been sold by Walker and Neill to Robert E. Swan
by virtue of that certain warranty deed dated December 14, 1979,
and recorded on December 20, 1979, in O.R. Book 322, at page
1699, of the public records of St. Lucie County, Florida; and
WHEREAS, the land sold to Swan has been released from the
lien and operation of the Mortgage by the Sun Bank by virtue
of that certain Partial Release dated December 7, 1979, and
recorded on December 20, 1979, in O.R. Book 322, at page 1704,
of the public records of St. Lucie County, Florida; and
WHEREAS, that certain purchase money mortgage given by the
aforesaid Robert E. Swan to Walker and Neill dated December 17,
1979, and recorded on December 20, 1979, in O.R. Book 322, at
page 1701, of the public records of St. Lucie County, Florida,
and the promissory note secured thereby in the original princi-
pal amount of $195,250.00 have been assigned by Walker and
Neill to Sun Bank as additional security for payment of the
aforementioned indebtedness in the amount of $225,000.00 as
evidenced by that certain Assignment dated December 14, 1979,
~ and recorded on December 20, 1979, in O.R. Book 322, at page
f 1705, of the public records of St. Lucie County, Florida; and
WHEREAS, Walker has conveyed to Neill all of his right,
title and interest in and to a portion of the lands presently
encumbered by the Mortgage,'which lands are more particularly
described in Schedule "A" attached hereto and by reference
made a part hereof, in return for a conveyance by Neill to
Walker of the remaining portion of the lands presently encum-
bered by the Mortgage as more particularly described in Schedule
~ "B" attached hereto and by reference made a part hereof; and
WHEREAS, Walker and Neill have requested the Sun Bank to
identify that portion of the aforementioned $225,000.00 indebt-
edness for which each of them will be responsible.
