O R D E R
A motion for enforcement was filed herein for alimony
previously ordered on ,September 13, 1979, in the sum of $100 per
month. Said order was made pursuant to a complaint to establish
a foreign judgment or decree as a Florida judgment from the state
of Ohio. The wife frankly admitted that she had remarried on
Mother's Day of this year ar~d the ruestion presented by the Court
is whether alimony stops upon remarriage of the former wife. ~
It is recognized in the State of Florida that the marriage
f
of the wife will generally allow the Court to revoke the provisions
f
of alimony. The remarriage of a wife is a material change of
~ circumstances which requires a modification in the form of termination
of future payments.
HENCE, the motion for enforcement filed herein is hereby
aenied.
