Defendant's Motion to Strike is denied. 2. Defendant's Motion to dismiss is granted with leave to the plaintiff to amend the complaint instants by inclusion j of the word "oral" in paragraph three of .the complaint. ` 3. The Defendant is given 15 days from date hereof in which to file and serve its answer. 4. The Plaintiff's Motion for Summary Judgment is denied E without prejudice to the Plaintiff to renew it at a later date.
