THIS CAUSE came on to be heard before men the undersigned
Judges upon the defendant's Motion to Dismiss and Motion
to Strike and the Plaintiffs Motion for Summary Judgment
and after hearing argument of counsel and being otherwise
fully advised in the premises it is thereupon
ORDERED:
1. Defendant's Motion to Strike is denied.
2. Defendant's Motion to dismiss is granted with leave to
the plaintiff to amend the complaint instants by inclusion
j
of the word "oral" in paragraph three of .the complaint.
` 3. The Defendant is given 15 days from date hereof in which
to file and serve its answer.
4. The Plaintiff's Motion for Summary Judgment is denied

without prejudice to the Plaintiff to renew it at a later
date.
