shall be undertaken within thirty (30) days after the damage
occurs and shall be completed within ninety (90) days after
the damage occurs, unless prevented by causes beyond the i
control of the Owner or Owners.
ARTICLE VIII
MEMBERSHIP AND VOTING RIGHTS

Section 1, Every Owner of a Parcel which is ;
subject to assessment shall be a member of the Association,
Membership shall be appurtenant to and may not be separated
from ownership of any Parcel which is subject to assessment.

Section 2. The Association shall have two classes i
of voting membership:
Class A: Class A members shall be all Owners with
the exception-the Declarant and shall be entitled to one ~
vote for each Parcel owned. When more than one person holds
an interest in any Parcel, all such persons shall be members..
The vote for such Parcel shall be exercised as they among
themselves determine, but in no event shall more than one
vote be cast with respect to any Parcel.
Class B: The Class B member shall be the Declarant
and shall e6 entiteld to three (3) votes for each Parcel
owned. The Class B membership shall cease and be converted
to Class A membership on the happening of either of the
following events, whichever occurs earlier: ~
(a) When the total votes outstanding in the
Class A membership equal the total votes
outstanding in the Class B membership, or
(b) One (1) year from the date hereof.

COVENANT FOR MAINTENANCE ASSESSMENTS
Section 1. Creation of the Lien and Personal
Obli ation of Assessments. Eac Owner o any _arce y
acceptance o a ee t erefor, whether or not it shall be so -
expressed in such deed, is deemed to covenant and agree to }
. pay to the Association: (1) annaul assessments or charges, ~
and (2) special assessments for capital improvements, such
assessments to be established and collected as hereinafter
provided. The annual and specia•1 assessments, together
• with interest, costs, and reasonable attorney's fees, shall
be a charge on the land and shall be a continuing lien F
upon the property against which each such assessment is
made. Each such assessment, together-with interest, costs,
and seasonable attorne}•'s fees, shall also be the personal
obligation of the person who was the Owner of such property
at the time when the assessment fell due. The personal
obligation for delinquent assessments shall not pass to -
his successors in title unless expressly assumed by them.
Section 2. Pur ose of Assessments. The assessments
levied by the Association s a e use exc usively to
promote the recreation, health, safety, and welfare of the
residents in the Property and for the improvement and
maintenance of the Common Area, Parcels and Townhouses. F
Section 3. Maximum Annual Assessment. Until
January 1 of the year imme late y o owing t e conveyance
of the first Parcel to an Owner, the maximum annual assessments
shall be Three Hundred Dollars ($300.00) per Parcel.
