FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF FORT PIERCE
MORTGAGE and SECURITY AGREEMENT
THIS MORTGAGE, executed this 1st day of July, 1980, by ELCO CON-
STRUCTION AND DEVELOPMENT, INC., A FLORIDA CORPORATION, hereinafter called
the mortgagor, which term as used in every instance shall include the mort-
gagor's successors, legal representatives and assigns, either voluntary
by act of the mortgagor or involuntary by operation of law, and shall denote
the singular dnd/or plural, and the masculine and/or feminine, and natural
and/or artificial persons, whenever and wherever the context so requires
or admits, party of the first part; and FIRST FEDERAL SAVINGS AND LOAN
ASSOCIATION OF FORT PIERCE, a corporation organized and existing under the
laws of the United States of America, hereinafter called the Association,
which term as used in every instance shall include the association's suc- .
cessors, legal representatives and assigns, party of the second part.
WITNESSETH:
That for divers good and valuable consideration, and in considera-
tion of the aggregate sum of money named in the promissory note of even
date herewith, hereinafter described, the mortgagor does grant, bargain,
sell, alien, remise, release, convey and confirm unto the Association, in
fee simple, the following described real estate, of which the mortgagor is
now seized and possessed and in actual possession, situate in the County of
St. Lucie, State of Florida, to wit:
Lots 22 and 24 and the Easterly 5 feet of Lots
21 and 23, Block 4, SUNRISE TERRACE SUBDIVISION,
according to the plat thereof on file in Plat
Book 5, page 55, Public Records of St. Lucie
County, Florida. .
By agreement of Mortgagor and Mortgagee on
file with Mortgagee, the within mortgage
secures not only an existing indebtedness, but
also ADVANCES to be HEREAFTER made by Mortgagee
to Mortgagor the aggregate of which will equal
~ the principal amount specified in the promissory
note secured hereby.
TO HAVE AND TO HOLD the same, together with all and singular the
tenements, hereditaments and appurtenances thereof, including all fixtures
1 and articles of personal property now or at any time hereafter attached to
~ or used in any way in connection with the use, operation and occupation of
~ the above described real estate, such fixtures and articles of personal
. property including, but without being limited to, all screens, awnings,
storm windows and doors, window shades, inlaid floor coverings, and all
heating, lighting, plumbing, electric, ventilating, air-conditioning
equipment, systems, machines and appliances of whatsoever kind and nature, _
all of which fixtures and articles of personal property are hereby declared
and shall be deemed to be fixtures and accessory to the freehold and a -
part-of the realty as between the parties hereto, their successors, legal
representatives and assigns, and all persons claiming by, through or under
them and shall be deemed to be a portion of the security for the indebted-
ness herein mentioned and to be subject to the lien of this mortgage, and
