PARTIAL RELEASE AND ABANDONMENT OF EASE2•tENT
THIS AGREEMENT made and entered into by and between INDIAN PINES GOLF
CLUB, INC., a Florida Corporation, and HOLIDAY PINES, a Florida General
Partnership;
WHEREAS, on the 20th day of December, 1972, NORTH TRAIL GOLF CLUB, INC.
and TRAFALGAR COMMUNITY DEVELOPERS, INC. entered into a certain GRANTS OF
EASEMENT, recorded in Official Records Book 209 Page 580, Public Records of
St. Lucie County, Florida, whereby easements were conveyed to each party over
property owned by the other and described therein; and,
WHEREAS, INDIAN PINES GOLF CLUB, INC., is the successor in interest and
owner in fee simple of the property described in Parcel A of the GRANTS OF
EASEMENT as described above and foomerly owned by NORTH TRAIL GOLF CLUB, INC.,
and HOLIDAY PINES is the successor in interest and owner in fee simple of the
property described in Parcel B of the GRANTS OF EASEMENT described above and
formerly owned by TRAFALGAR COMMUNITY DEVELOPERS, INC.; and,
WHEREAS, the parties hereto agree that part of the easement set forth in
the GRANT OF EASEMENT described above is no longer used and enjoyed nor needed
by the parties hereto,
NOW THEREFORE, in consideration of the premises and the sum of Ten Dollars
and other good and valuable consideration, receipt of which is acknowledged the
one from the other, it is mutually .agreed and covenanted that part of the
easement shown in the GRANT OF EASEME'~T described above shall be partially
released, cancelled, terminated, quitclaimed and abandoned as more particularly
set forth as follows:
From the Southeast corner of the West 1/2 of the Northwest 1/4
of Section 7, Township 34 South, Range 40 East, run North
00°34' East 945.91 feet;-thence North 89°26' West 1152.24 feet;
thence South 31°06'10" East 327.84 feet to the Point of
Beginning; thence South 84°57'25" East 155.41 feet, thence South
62°14'40" East 232.75 feet; thenceNortt? 89° 26' West 131.33 feet;
thence North 62°14'40" West 105.13 feet; thence North 84°57'25"
West 275.18 feet; thence North 59°16'.30" EasX 1Q1.97 feet to the
Point~of Beginning.
IN WITNESS WHEREOF, the parties hereto have caused these presents to be
executed by their duly authorized corporate officers and caused their
