Escrow Agent shall be paid by Developer. '
6. Liability of Escrow Agents Limitations Dispute: Provided
Escrow Agent bas faithfully perfor~aed its duties under this Escrow
Agreement; then Esecor? Agent shall have no liability nor obligation to
either Developer or the purchaser nor shall Escrow Agent be liable for
responsible to Developer or the purchaser for any court costs,
attorneys' fees or other like costs. In the event _of a dispute bet-
ween the parties, Escrow Agent nwy file an interpleader action for
the purpose of obtaining a judgment directing payment of the escrowed
funds. In the event of the filing of such interpleader act ion, Escrow
Agent shall be entitled to receive all court costs, its attorneys'
fees and all other expenses connected with the bringing of such
action froze the escrowed funds.
7. Gender: The use of the singular number shall include the
plural, and the plural the singular; the use of any gender shall
include all genders.
8. Binding Effect: This Agreement shall bind and inure to
the benefit of the parties, the purchaser involved and their- heirs,
personal representatives, successors and assigns.
9. Caption: Captions are inserted in this Agreement for
convenience and reference onlg and shall not be taken in any way to _
limit or describe the scope of this Agreement or any provision
thereof .
