HomeMy WebLinkAbout1537 Section 1 -Plans -Reserved Right of Developer to Alter Unsold Units i' The improvements on the land will consist of those shown on Exhibit "B". i Developer reserves the right to change the interior design and arrangement of all units and to alter the boundaries between units, so long as developer owns the unf is so altered . No such change shall increase the number of apartments or alter the boundaries of the ' common elements without amendment of this Declaration by approval of the association, apartment owners and holders and owners of mortgages in the manner Elsewhere provided. If developer makes any changes in units~so affected, developer shall apportion between the units the shares in the common elements appurtenant to the units affected . Section 2 -Easements Each of the following easements is a covenant running with the Iand of the condominium and notwithstanding any of the provisions of this Declaration, may not be amended or revoked and shall survive the termination of the condominium and the exclusion of any of the lands of the condominium, from the condominium. A. Utilities: Easements through the apartments and other common areas for conduits, ducts, plumbing, wiring and other facili- ties for the furnishing of utility services to other apartments and the common elements; however, such easements through an apartment shall be only according to the plans and specfficiations for the apartment building or as the building is constructed unless approved in writing by the apartment owners. B. Pedestrian and Vehicular Traffic: Easements for pedestrian traffic over, through and across sidewalks, paths, walks and lanes, as the same may from time to time exist, upon the canmon elements; and for the vehicular, traffic over, through and across such portions of the common elements as may from ~ time to time be paved and intended for such purposes. C. General Easements: Easements for ingress, egress, sup- port, maintenance, repair, replacement and utilities. D.
