HomeMy WebLinkAbout1054 hie Unit (such ae tho surfaces pf the walls, ceilings, floors, etc.), whether or not part of th® Unit or Common Elements, and to maintain and repair tha fixtures therein, which includes but is not limited to the following where applicable: air conditioning and heating units, refrigerators, stoves, fans and hot water heaters, all plumbing and water lines within the Unit, electric panels, electric wiring and electric fixtures within the Unit, all windows, screening and glass, and to pay for such utilities as are separately metered to his Unit. Where a Unit is carpeted, the cost of replacing carpeting shall be borne by the Owner of said Unit. Likewise,•where a Unit is furnished, the cost of replacing or repairing such furniture-shall be borne by the Owner of said Unit. - (2) Additions. Not to make or cause to be made any structural add3t~on or alteration to his Unit, or to the Common or Limited Common Elements, without the prior written consent of the Association and of the holders of all mortgages secured by his Unit. (3) No Chan a to Common or Limited Common Elements.- To make no alteration, ecorat on, reps r, replacement or change of the Common~or Limited Common Elements, or to any outside or exterior portion of the building including porches, terraces, balconies (which includes screening or closing of same), and courtyards, whether within a Unit or part of the Common Elements, without the prior written consent of the Board_of Directors. (4) Ins ection b Association. To allow the Board of Directors, and the r agents an employees to enter into any Unit .for the purpose of mnaintenance, inspection, repair, replacement of the improvements within the Units or the Common Elements, or to determine, in case of emergency, circumstances threatening Units or the Common or Limited Common Elements, or to determine compliance with the provisions of this Declaration and the By- Laws of the Association. (5) Prohibitions. To show no .signs, advertisements or notices of any type on the Common or Limited Common Elements, or his Unit and. erect no exterior antenna and aerials except as consented to by the Board of Directors of the Association;~however, if the Developer provides a Master Television Antenna System or CATV hookups, no aerials shall be allowed under any circumstances except as are necessary for said CATV or Master Antenna System. f The provisions hereof relating to signs, advertisements and ` notices shall not apply to the Developer. i (6) Developer's Right to Enter. To allow the Developer to enter his Unit to alter utility lines, cables, pipes, and other utility facilities for a period of two (2) years after said Unit has been conveyed to him, provided, however, that in such - event the Developer shall fully restore and repair the premises from the effects of such alteration. C. Failure to Maintain b Unit Owner. In the event the Owner of a Unit a is to ma ntain it an the Limited Common Elements, as required herein, or makes any addition or alteration without the required written consent, or otherwise violates or threatens to violate the provisions hereof, the Association, shall have the right to proceed in a court of law for an injunction to seek compliance with the provisions hereof.
