"Developer", for itself, its successors, grantees and assigns.
. WHBRBIN, the Developer makes the following declarations:
1. PURPOSB =
The purpose of-this Declaration is to submit the lands f
described in this instrument and improvements on such lands to the
condominium form of ownership and use in the manner provided by
Chapter 718, Florida Statutes, 1977, hereinafter called the
Condominium Actf and the Developer does hereby submit the condomin- ~
ium property to condominium ownership.
2. NAMB AND ADDRBSS
The name by which this condominium is to be identified
is OCEAN HARBOUR CONDOMINIUM A, and its mailing address is 5151 N.
State Road AlA, North Heach, Fort Pierce, Florida 33450,
hereinafter called "The Condominium".
3. THB LAND
3.1 Description. The lands owned by Developer, which
by this instrwnent are submitted to the condominium forms of owner-
ship, are located in St. Lucie County, Florida, more particularly
described in Bxhibit "A-1", which is attached hereto and made a
part hereof.
3.2 Title Bxceptions.
(a) Construction loan mortgage to Inland Mortgage and
Investment Corp., dated December 22 , 197 8, encumbering Bxhibit "A-1"
lands, securing $ 3,300,000.00,-and filed for record in the Office
of the Clerk of the Circuit Court in and for St. Lucie County,
Florida, in Official Records Book 300 , Page 2029

~ - (b) Purchase Mloney mortgage to JAMES J. PARDIECR,
Trustee, dated December 22 , 1978, encumbering Exhibit "A-1"
lands, securing $ 1,SOO,000.Oq and filed for record in the Office
of the Clerk of the Circuit Court in and for St. Lucie County,
Florida, in Official Records Book 300 , page 2023

(c) Subject to reservation of 200 foot wide road ~
easement for the benefit of the Department of Transportation of
~ the State of Florida lying 100 feet on each aide of the centerline
• of State Road A-1-A.
4. DEFINITIONS ~

' and in all amendments thereto, shall have the meanings stated in
~ the Condominium Act (Section 718.103, Florida Statutes, 1977) and
as follows unless the context otherwise requires:

4.1 Apartment means unit as defined by the Condominium
