ORDER
This cause coming before the court on the counterclaim and
cross-claim for interpleader of Defendant MOBILE HOME ENVIRONMENTAL
SYSTEMS, INC., the court finds the following facts:
1. That MOBILE HOMES entered into a general contract
with the-Defendant JOBEAR for subdivision development.
- 2. That JOBEAR entered into a subcontract with Plaintiff
ALIAS SMITH-JONES, INC., and ALIAS SMITH-JONES, INC., claims an -
~ amount of $36,000..00 for sums owed but not yet paid by JOBEAR.
~f 3. That there exists a dispute as between ALIAS SMITH-JONES,

~ INC., and JOBEAR, INC., as to the amount to be paid to ALIAS
' SMITH-JONES, INC.
f 4. MOBILE HOMES holds the sum of $36,000.00 Which it is
ready and willing to pay to the party entitled to receive it.
5. There is no collusion between MOBILE HOMES and any
other party to this action and MOBILE HOMES is indifferent to
the claims of the other parties. -

g 6. That it appears tq the court that the counterclaim and
cross-claim for interpleader is proper . It is therefore

ORDERED AND ADJUDGED, as follows:
1. The counterclaim and cross-claim for interpleader of
MOBILE HOMES ENVIRONMENTAL SYSTEMS, INC., is hereby allowed.-
2. MOBILE HOMES is required to deposit the funds of
~ $36,000.00 into the registry of this court.
