6y grunts, bargains, sells. aliens, remises. conveys and confirms unto the mortgagee all the certain land
of which the mortgagor is now seized and in possession situate in St. Lucie County.
Florida, viz:
Lot-24 of MELTONS RIVERVIEW SUBDIVISION; according to the plat
thereof recorded in Plat Book 9, Page 43 of the Public Records
of St. Lucie County, Florida.
The Mortgagee acknowledges that it has concurrently. with the exe-
cution and delivery of this instrument conveyed the above-described
property to the Mortgagor and acknowledges that the property at the
time of said conveyance is. encumbered by the following mortgage lien
to wit:
That certain mortgage from Indian River Gardens, Inc. to Frank
Tyrpekle and Nell Tyrpekle, his wife, dated May 9, 1977 and recorddd
May 10, 1977 in O.R. Book 267, Page 2620 of the. Public Records of
St. Lucie County, Florida in the original principal amount of
$11,360.00.
The mortgagee warrants that the foregoing mortgage is in good stand-
I~i ing and mortgagee agrees that it shall continue to be its obligation
to pay and discharge said obligation promptly as it becomes due.
! Mortgagee agrees to indemnify and hold harmless the Mortgagor of
~ and from any claim, loss or damage on account of the existence of
said mortgage and Mortgagee agrees that if it fails to pay any sum
promptly when due then the Mortgagor at her option may pay the same
and deduct the amount of such payment together with interest thereon
E -at 10$ per annum from the_next payment coming due under the terms
and conditions secured by this mortgage. From time to time prior .
to the due date of the payments on the note secured b_y this mortgage
the Mortgagee will furnish to the Mortgagor copies of cancelled
checks or other satisfactory evidence reflecting that the payments
on the above mortgage are current.
