COST AND ATTORNEY'S FEE JUDGMENT
_ THIS CASE, having cane on before the Court upon the
Motion of the Plaintiff, INVESTORS DIVERSIFIED LIMITED INC.,
_ d/b/a JOHNNY'S AUTO REPAIR, to tax costs and attorney's fees,
pursuant to the Judgment rendered by this Court on the 27th
day of August, 1980, and the Court having-considered the same,
hearing the arguments of counsel, having heard testimony of
Plaintiff's expert witness that after reviewing Plaintiff's
file that a 1/3 contingency fee or $100 per hour based upon 38.1
hours of work or a fee of $4,000 would be fair and reasonable, and
Defendant's expert witness that after reviewing the Defense file,
that Defense attorney worked 32.0 hours, 6 of which was travel

time, that a fee $60-$75 per hour was fair and reasonable, it is
hereby,
ORDERED AND ADJUDGED that Plaintiff is awarded attorney's
- fees in the amount of $4,000. Further, upon stipulation of counsel
for the Defendant and counsel for the Plaintiff, it is
ORDERED AND ADJUDGED that the Plaintiff, INVESTORS DIVERSIFIED
LIMITED, INC., d/b/a JOHNNY'S AUTO-REPAIR, have and recover a
~ judgment against the Defendant, SECURITY INSURANCE COMPANY OF
~ HARTFORD, for costs in the amount of Ninety and 80/100 Dollars
($90.80), nunc pro tunc, August 27, 1980, for all of which let
~ execution issue.
DONE AND ORDERED in chambers at-St. Lucie County, Fort Pierce, ,
