SUMMARY JUDGMENT
THIS CAUSE coming on to be heard on Defendants' Tommy
Edenfield and Frances J. Edenfield motion for summary judgment,
and the Court having considered the pleadings and depositions,
finds and determines that there .are no genuine issues of facts,
and that the said Defendants are entitled to a summary judgment
in their favor.. The affidavit of the Plaintiff is based entirely
on information and belief and not on personal knowledge, and is
therefore insufficient to create a genuine issue of facts as to
the alleged facts in this affidavit. Orthwein v Cobbs Fruit and

Preserving Company, 229 Sold 607 (1 DCA 1969). It is~thereupon

ORDERED and ADJUDGED that the said Defendants' motion
for summary judgment iri their favor be and the same is hereby
granted. That the Plaintiff, The Furst Company of Fort Pierce,
as to the Defendants, .Tommy Edenfield and Frances J. Edenfield,
take nothing by this action, and that said Defendants go hence
without day and recover their costs f Plaintiff.
