~ ~ RECEIPT, ACiCNOWLEDGMSNT, ASSUMPTION AND ACCEPTANCE OF PURCHASER ~
l ~ Purchaser, by acceptance and execution of this Receipt, acknowledges that this a
purchase of a condominium unit at OCEAN VILLAGE OF HUTCHINSON ISLAND is subject
~ ~ ir. every respect to the Declaration of Condominium as to the condominium in ~
which his unit is located and Exhibits attached thereto, including but not lim-
~~•f~ ited to (whether the same are attached to the Declaration of Condominium or re- j
ferred to therein), the By-Laws of the Association, Articles of Incorporation, t.
` the Rules and Regulations, copy of projected operating budget, copy of sales
brochure and floor plan of apartment purchased by purchaser, and all Amendments
\~_~1 to the aforesaid Declaration and Exhibits and the Articles of Incorporation,
By-Laws and Declaration of Covenants and Restrictions of the Property Owners
Association; and Purchaser further acknowledges receipt of and reading and
examination of said Declaration, its Exhibits, budget, sales brochure and floor ~
plan, and acknowledges that each and every provision of the foregoing is essen-
tial, to the successful operation and management of the Condominium property ~
and is in the best interests and for the benefit of all the owners therein.
L Purchaser and all a~rners of parcels in the aforedescribed Condominium coven- f
- ant and agree to abide by each and every provision of said Declaration and
Exhibits attached thereto. Purchaser hereby ratifies and confirms and approves
_ all of the terms and provisions of said Declaration of Condominium and Exhibits K
attached thereto, and agrees that the assessment under the Property Owner's
Association documents referred to above and the provisions thereof are reason-
able, fair and equitable, and said Purchaser acknowledges and confirms that the
Declaration of Covenants and Restrictions of the Property Owner's Association
has encumbered and impressed a lien upon the Condominium parcel being conveyed
to Purchaser, as security for his obligations under said Declaration of Coven-
ants and Restrictions, and said Purchaser assumas the obligations as to the l
:Y~ Property Owner's Association as to his condominium parcel. Purchaser confirms
that all warranties, representations, and inducements, if any, are as contained
_ in the aforesaid Declaration of Condominium and Exhibits attached thereto, and
•~-s the common expenses•and the sums due under the Property Owners Association and
- other charges are estimated only. No warranty or guaranty is made or intended ~
~ nor may one be relied upon except where the same is specifically warranted or
guaranteed in said Declaration of Condaminium and Exhibits attached thereto.
