HomeMy WebLinkAbout0813 5112:3'71 ~ ~ MORTGAGE MODIFICATION AGREEMENT Re: Real Estate situated in St. Lucie County, Florida, legally described as: From the Northwest corner of the NE I/4 of the NE 1/4 of the NE 1/4 of Section 9, Township 36 South, Range 40 East, run South along the West line of said NE 1/4 of NE 1/4 of NE 1/4 for a distance of 228.86 feet to the point of beginning; thence con- tinue South along said West line for a distance of 121 feet to a point that is 312.5 feet from the South line of said NE 1/4 of NE 1/4 of NE 1/4, thence run East parallel to said South line for a distance of 202 feet, thence run North for a distance of 121 feet, thence run West for a distance of 202 feet to the point of beginning; LESS AND EXCEPTING THEREFROM the West 20 feet for road right of way. All lying and being in St. Lucie County, Florida, containing 0.5 acre, more or less. WHEREAS, Claude C. Davis and Lillian Davis, his wife, are the owners of a first mortgage encumbering the above described real property, bearing date of June 22, 1980, recorded in O.R. Book 334, page 391, public records of St. Lucie County, Florida, securing a promissory note therein described; the same having a balance due this date in the aggregate sum of $8,529.14; and WHEREAS, Robert E. Stein, the mortgagor, wishes at this time to make a substantial payment in order to reduce the principal indebtedness secured by said mortgage and note, said payment being in the amount of $4,200; and WHEREAS, the parties hereto for the mutual considera- tions herein set forth wish to revise the terms of payment thereof; NOW, THEREFORE, it is agreed that the unpaid balance of said indebtedness upon the date of this agreement is - $4,329.14, and that the undersigned mortgagor hereby promises to pay said amount, with interest as stated in said note, at the rate of $125 per month beginning on the 2nd day of October, 1980, to be applied first to interest at the rate - of 14 per cent per annum upon the unpaid balance of said indebtedness and the balance to principal until said indebted- ness is paid in full. In all other respects said note and mortgage shall remain in full force and effect, and the undersigned promises to pay said indebtedness as herein stated and to perform all of the obligations of said mortgage as herein revised.
