In consideration of the .foregoing undertakings of the wife, and of her acceptance of the foregoing, the husband hereby agrees: i 3 (a) To release all claims whatsoever against the wife, i including all claims of the husband upon the wife and her heirs and personal representatives, for any right of courtesy, or inheritance, or homestead created by the laws of the State of Florida, or by the laws of any other state, and all right, title, claim, and interest of the husband, arising by way of courtesy, homestead, or inheritance, or otherwise, in all property of the wife, whether real, personal, or mixed, and wheresoever situated, and whether the same be now owned or possessed or hereafter acquired by her, and whether her title thereto be legal or equitable, so that all claims of the husband against the wife or, her estate shall forever cease, with the exception that all of the undertakings of the wife contained in any other agreement or instrument entered into and executed by her at or-about the time of the execution hereof, in favor of or for the benefit of the husband, shall be hereafter enforceable by the husband against the wife and her heirs and personal representatives, according to their terms; and (b) To undertake to execute and deliver to the wife, or to whomsoever she may designate, all instruments necessary to carry into I ~ effect or to evidence the undertaking, releases, and acceptance of the f husband hereinabove set forth.. ' 9. The parties shall file a separate Federal income tax return for the year 1980. Each of the parties shall file separate income tax returns for the years thereafter and pay all income taxes due with respect to his or her income. The husband shall indemnify the wife, and hold her free from any liability or loss whatsoever, on account of any taxes or income heretofore or hereafter earned or received by the ~ husband, and on their community or joint income to the date of the execution of this Agreement. The wife shall indemnify the husband, ~ and hold him free from any liability or loss whatsoever, on account of any taxes on income hereafter earned or received by the wife. ` 10.
