such action insofar as any provisions for the division and settlement
of property and the payment and fees and costs thereto are concerned.
Each party may request the Court to recognize this Agreement as a bar
to any other and further provisions, and the Court may, in its dis -
cretion, incorporate the terms hereof by reference in a final decree
which may be entered in said suit, however, such incorporation by
reference into such decree shall not prevent this Agreement being
enforced by separate suit based thereon:
11. Modification or waiver of any of the provisions of this
Agreement shall be effective only if made in writing and executed with
the.same formality as this Agreement. Failure of either party to
insist upon strict performance of any of the provisions of this
Agreement shall not be construed as a waiver of any subsequent default
of'the same or similar nature.
12. This Agreement shall be construed and governed in accordance
with the laws of the-State of Florida. '
13. If any provision of this Agreement is held to be invalid or
unenforceable, all other provisions shall nevertheless continue in
~ full force and effect.
