SEVENTH: All the remainder of-the .property I have the
right to dispose of -at death by Will, including property as to
which effective disposition is not made in this Will, is defined
as my "residuary estate." I do not intend to exercise any powers
of appointment in this paragraph, and as stated above, my residuary
estate shall not consist-of any assets derived from the estate of
my mother, ZONA SALSMAN. My residuary. estate shall be divided
into five (5) equal shares and distributed as follows:
A. I give an amount-of money equivalent to twenty percent
(209',) of my residuary estate to each of the following individuals,-
per stirpes: my wife, LOUISE NETHERY; my daughter, ZONA ELIZABETH
BOND; my daughter, IRENE EVELYN DUNSHEE; and my son, ROBERT W.
NETHERY.
B. I-further give an amount of money equivalent to twenty
percent (20%) of my residuary estate to my trustee nominated below
for the use and benefit of my wife's children, DESTINY NETHERY,
RANDY NETHERY, ANDY NETHERY,-and. ANN CAREEN, until the youngest
thereof is twenty-dive (25) years of age. The trustee. is authorized
to pay and distribute to such living children-and descendants, or
apply for their benefit, so much of the principal of the trust as
the trustee, in his discretion, deems advisable for their health,

maintenance, support and complete education, including preparatory,
college, postgraduate, or professional training. In making
discretionary payments under this trust, my trustee shall consider
the assets and income otherwise available to such beneficiary from
all other sources known to the trustees the nature of the assets
~ of the trust, the size of the-trust, and the future requirements
of such beneficiary.and the other-beneficiaries thereof. The
trustee shall be under no duty to equalize disbursements of princi-

pal as herein authorized, nor shall any such disbursements of
principal be charged against the share herein provided for said
beneficiaries and their descendants.
