Zhis Joint Use Agreenent entered into by and between C~RAID S. JAS, First

Party, and Wi00D~i0W S. SAFRTI, Second Party, their heirs, suooessors and assigns,
for and in consideration of $1.00 and other valuable consideration, ;
- ~~lS, the First Party has executed a contract for purdsase to certain
lands from PHILIP A. ~~'NER and DfARIE HOAR, his wife, legal description of

said lands is attached hereto as F~chibit 1. -

ArD WEO~AS, the Second Party has executed a contract for purchase to {

adjacaent lands from PHILIP A. FIOEFFt~R and I~RIE HDEF~it, his wife, legal descrip-

tion of said lands is attached hereto as Exhibit 2. i

Aim WAS, the Parties desire to enter into an easa~nt for drainage along -
the South 35 feet of the lands under Exhibits 1 aryl 2, owned by First Party and
Second Party, respectively.
NOW, Tf2E, the Parties enter into this Joint Use Agrt covering
the South 35 feet of parcels described .in Exhibits 1 and 2, attached hereto, with
the mutual and equal right-to drain all surface waters, affluents and any and all '

necessary drainage outfall for the joint benefit of the total tract under purchase
agreements to the respective ].ands. -

IT IS AGREm arri understood .that in the event additional lands are f
required to be purchased to secure positive drainage outfall from the easement -
I - -
~ herein described to insure the connection with a public drainage easement, the
~ -
~ Parties agree to divide equally all necessary costs and-expenses to otherwise
fully secure all necessary drainage for the total tract herein purchased.
