THE COMPLAINT AND MOTION FOR
MORE DEFINITE STATEMENT
THIS CAUSE coming on this day to be heard upon Defendant's _
Motion to Dismiss the Complaint and Defendant's Motion for a More
Definite Statement, and the Court being fully advised in the premises,
it is hereby
ORDERED AND ADJUDGED as follows:
1. That the Defendant's Motion to Dismiss Counts I and
II of the Complaint is denied;
2. That Defendant's Motion to Dismiss Counts IIl.and IV
of the Complaint is granted; .
3. That .the Defendant's Motion for a More Definite
Statement is denied, except that Plaintiff be~required to allege
with more specificity as to Count II of the Complaint the time for
performance of the alleged contract.

-4. Plaintiff shall have fifteen (15) days from the date
of the entry of this order within which to file and serve an amended
complaint.
