of interest to such sums which shall not result in any payments to-
ward principal in accordance with the requirements of the preceding
sentence. In no event shall any agreed to or actual exaction as
consideration for this loan transcend the limits imposed or pro-
vided by the law-applicable to this transaction or the makers here-
of in the jurisdiction in which the land is located for the use or
detention of money or for forbearance in seeking its collection.
19. Mortgagor warrants that the irrigation equipment recited ~
on page one of this Mortgage shall be used only on the above de-
scribed real property and solely for purposes of irrigation;
covenants that no other security interests in said it=igation
equipment has been given; agrees not to-sell, lease, encumber
or otherwise-dispose of said irrigation equipment, or remove
.the same from the County in which the same is now situate,
. without the prior written consent; and agrees to defend against - _
all adverse claims and demands which may be made against said
irrigation equipment.
20. This mortgage•shall secure not only existing indebted-
ness, but also such future advances, whether such advances are
obligatory or to be made at the option of the Mortgagee, or
otherwise, as are made within twenty (20) years from the date
hereof, to the same extent as if such future advances were made
on the date of the execution of this Mortgage, but such secured
indebtedness shall not exceed at any time the maximum principal
amount of TWO HUNDRED THOUSAND AND 00/100 DOLLARS ($200,000.00)
,plus interest and any disbursements made for the payment of
taxes, levies or insurance on the property covered by the lien of
this mortgage, with interest on such disbursements.
This Mortgage shall inure to and bind the heirs, legatees,
devisees, administrators, executors, successors and assigns of ~ -
the parties hereto. Wherever used herein, the singular number
shall include the plural, the plural the singular, and the use,
of any gender shall be applicable to all genders.
Mortgagee shall be subrogated to the claims and liens of all
parties whose claims or liens are discharged or paid with the pro-
ceeds of the loan secured hereby. _
