HomeMy WebLinkAbout0638 2: The Defendants, RICHARD VREELAND and CAROL VREELAND, his
wife, shall execute and deliver to the attorney for EDWARD F. MESSNER
and LORNA J. MESSNER, his wife, an assignment of their wrap-around
mortgage, dated February 21, 1979, which is recorded in the Official
Record Book 303, Page 2621, of the Public Records of St. Lucie County,
Florida, which assignment shall be to JOSEPH E. MESSNER and HELEN
MESSNER, of 114 Amy Lane, in Fort Pierce, Florida.
3. Prior to any Order of Dismissal being entered, the Plaintiff,
CITICORP HOMEOWNERS, INC., shall deliver and/or execute and deliver,
as the case may be, to the attorney for Defendants, EDWARD F. MESSNER
and LORNA J. MESSNER, his wife, the original Note, Security Interest
and Mortgage upon the mobile home, subject matter of this action, the
title_certificates for the double=wide mobile home, properly executed
Power of Attorney pertaininE to said titles, executed by ROBERT E. COLE
and MARIE H. COLE, his wife, and as Assignment of the~Note, Security r
Interest, Mortgage .and indebtedness represented thereby, held by the
Plaintiff, which Assignment shall be to JOSEPH E. MESSNER and HELEN
MESSNER, 114 Amy Lane, Fort Pierce, Florida.
4. I~t is-hereby stipulated and agreed, by the parties hereto
that any Dismissal carries with it a full release by, between and _
among all of the parties to this Stipulation, as to any and all clai_ras
of the parties to this. Stipulation, as to any 'and all claims raise:?

claim of EDWARD F. MESSNER and LORNA J. MESSNER, his wife, against

REGINALD J. PARADIS and DOROTHY M. PARADIS, his wife.. -
5. All funds presently held in the Registry of the Court shall
be disbursed and remitted to Charles A. Sullivan, Attorney for EDWARD
i F. MESSNER and LORNA J. MESSNER, his wife, less any Clerk's fees that
may be applicable. -
