THIS CAUSE came on for trial. on the ,29th day of September,
1980, and the Court having heard testimony of witnesses, considered
the evidence, and having heard argument of counsel and being otherwise
fully and well advised in the premises, thefCourt finds that the
Defendant failed to meet his burden of proof on the affirmative defense

of failure of consideration due to the fact that there was no evidence
as to contributions by VINCENT VECCHIO to Eastern Tomato Company. It
is thereupon
ORDERED AND ADJUDGED that the Plaintiff, SUN BANK OF ST.
I~ LUCIE COUNTY, as Personal Representative of the Estate of VINCENT
~ VECCHIO, Deceased, shall have and recover of and from the Defendant,
~ ROBERT RAMSEY,-the sum of $22,518.00 plus 6 percent interest from

June 1, 1977, until the date of this Order, plus its costs to be taxed
` by .special order. of this Court, for which let execution issue.
