THIS CAUSE coming on to be heard upon motion for
summary judgment by Plaintiff, Belly Tractor Company, and the
Court having previously reserved ruling upon this motion and -
having duly considered memoranda of law, upon due considera-
tion, the Court finds there are material disputed issues of
fact as to whether the parties reached an agreement as to the
amount due.
It is-thereupon
ORDERED and ADJUDGED that Plaintiff's motion for summary

judgment is denied.
