AGREED ORDER - -
REQUIRING REMEDIAL MEASURES
This cause came to be .heard upon the Stipulation of the parties to the entry
of this Agreed Order, and it appearing to the Court that the parties have agreed
to the entry of this Order, and the Court being otherwise fully advised in the
premises, it is hereby
ORDERED AND ADJUDGID as follows:
1. That Defendant Tilton shall apply for a DER dredge and fill permit
to install two (2) 47" x 71" x 20 feet ACSP culverts within 5 days from the
date of this Order..
a. Said culverts shall be placed side by side at the location of the
existing 30" culvert.
b. Said culverts shall be installed at an invert elevation of 12.5
feet NGVD.
c. Said culverts shall be stabilized by sodding.
2. That immediately upon receiving a dredge and fill permit from DER,
~ Defendant Tilton shall commence installing the culverts.

3. That Defendant Tilton shall remove the fill adjacent to the culverts
to a depth of 13.5' NGVD.
4. That Defendant Tilton shall-grass and stabilize the bank alongside
and adjacent to the causeway.

5. That all the above remedial measures shall be completed within one

~ week of receipt of the DER permit.

6. That upon completion of the above, the SFWMD shall voluntarily dismiss t

the Complaint with prejudice as to Defendants, Ransom R. Tilton, Jr., and Sharon `
O. Tilton, his wife and Ransom R. Tilton.
