O R D E R
THIS CAUSE, having come on before the Court
upon the Motions of the Defendants, M.A. RAMSEY, PHILIP ZIPES
and LEON D. MILLER d/b/a LAKESIDE MOBIEL HOME SALES, and
DEPENDABLE INSURANCE COMPANY, to Dismiss the Crossclaim and
Third-Party Complaint and for a Summary Judgment, and the .
Court having considered the same, hearing the arguments of
counsel and `being otherwise fully advised in the premises, it
is hereby -
ORDERED AND ADJUDGED as follows:
1. The l~vtion to Dismiss the Crossclaim of BARRINGiCN and RDYAL
GLOBE INSURANCE COMPANY, against the Defendants, M.A. RAMSEY,
d LAKESIDE MOBILE HOME
PHILIP ZIPES"and LEAN D. MILLER /b/a
€ SALES, and DEPENDABLE INSURANCE COMPANY, INC.", is dismissed
as to the claim for indemnification contained in Count I, but
is denied as to the claim for contribution contained in .Count II;
2. The Motion to Dismiss the Third Party Complaint
against DEPENDABLE INSURANCE COMPANY, is denied;
3. The Motion for Summary Judgment is denied,
the Court, finding that there exists a genuine issue of material
fact. .
