PETITION FOR LEAVE TO SELL The Petition of PHILIP DESIND and JULIA SMALL respectfully shows: 1. MAY D. FISHER died on July 18, 1978, leaving a Last Will and Testament in which petitioners were named as co-Personal Repre- sentatives; an authenticated copy of said Will was admitted to pro- bate on March 15, 1979, and petitioners on -that date qualified as co-Personal Representatives; the petitioners deem it for the best ` interest of the estate, and necessary to provide funds for cash . i bequests and payment of claims and expenses, that the following des- cribed property of the estate be sold: The NWT of the SW's, less 5.52 acres in the NW corner and - less tracts to Hazellief and Bernard, and less the West t 33 feet for road right-of-way in Section 31, Township 34 ' South, Range 40 East, St. Lucie County, Florida. (More particularly described on Schedule "A" attached hereto.) ~ 2. The above described property is titled in Florida Home- i sites Estates, Inc., which is a dissolved New York corporation. The decedent, MAY D. FISHER, owned one-half of the stock of said corporation. 0 3. Petitioners entered into a contract for sale dated December 14, 1979 as to said property with Robert-N. Rebel, Jr. and wife for Fifty-Three Thousand ($53,000.00) Dollars cash, which contract was 3 subsequently assigned to JESSE HAMILTON and INEZ HAMILTON, his wife. 4. It will be to the best interest of the estate to sell said r property at private sale pursuant to the contract set out above.
