HomeMy WebLinkAbout0029 ASSIGNMENT ROBERT N. REBEL, JR., and BETTY J. REBEL, for and in consideration of $5,000.00 to be held in escrow by Hoyt C. Murphy, Inc., do hereby sell, assign, convey and transfer to JESSE HAMILTON and INEZ HAMILTON, his wife, their interest in that certain contract for sale and purchase entered into by them as Buyer, with JOSEPH DAVIS, et al, as Seller, a copy of which is attached hereto. In consideration of this assignment, HAMILTONS agree to ' work with attorneys for the Seller and try to clear title to the property and close the same. If title is cleared and the transaction is closed between HAMILTONS, then at the time of closing, HAMILTONS will pay $1,000.00 per acre to the REBELS in addition to paying the purchase price to JOSEPH DAV?S, et al. HAMILTONS, in addition, agree to pay .any surveying expenses incurred by REBELS. The parties acknow*eldge that Hoyt C. Murphy, Inc., pre- sently holds a $5,000.00 deposit which shall be returned to the REBELS and the $5,000.00 sur;t mentioned above will be paid by HA~:ILTONS to Hoyt C. Murphy, Inc., to be held in escrow in the place of the deposit posted by the NEWELS. The parties acknowledge that certain title defects exist which have delayed the closing~of this transaction and it is agreed that if those defects are not cleared witt,in 120 days, then fiAMILTONS may elect to terminate the contract, and will re- assign the same to the REBELS, and shall be entitled to the return of their deposit and will be under no further obliga- tion to the REBELS.
